1. Scope, Changes

1.1 The website operator of the domain (hereinafter referred to as 'Provider') offers the use of FireChatbot on this website to inform website visitors (hereinafter referred to as 'Users'). These terms of use govern the usage relationship between the users of FireChatbot and the provider.

1.2 The provider reserves the right to change these terms of use at any time if this becomes necessary due to changes in legislation, altered case law, changed economic conditions, or subsequently revealed gaps in these terms of use. Users will be informed of such changes before using the chatbot again.

2. Object of Use, Service Availability

2.1 The chatbot serves to improve the user's utilization of the website and to provide general information about the content found on the website. The use of the chatbot is free of charge for users and does not require registration.

2.2 The provider does not guarantee the accuracy, completeness, reliability, timeliness, or usefulness of the answers provided by FireChatbot. FireChatbot is not suitable for making general or specific statements about content or facts that do not relate to the website domain or for providing the user with hints, instructions, or advice.

2.3 The purpose of FireChatbot is purely general in nature and is solely to facilitate the user's access to the information on the website. FireChatbot is not capable of making legally binding statements (e.g., about delivery times or granting discounts). It is also not possible to conclude contracts via FireChatbot. All supposedly legally binding statements from FireChatbot are to be considered null and void.

3. Intellectual Property

3.1 The provider believes that the generation of texts using FireChatbot does not constitute a creative process in the sense of copyright law, so no copyright-protected works are created. Neither the provider nor the user who entered the text for text generation has any rights to the generated text.

4. User Obligations

4.1 The user may only use FireChatbot for its intended purposes. The user may not use FireChatbot in any abusive manner. The user expressly agrees to comply with the content guidelines according to section 5 of these terms of use. The provider reserves the right to file a criminal complaint with the appropriate authorities in the event of violations.

4.2 If a user notices obvious errors in FireChatbot that could be used to abuse FireChatbot or the content contained therein, they are obliged to report the error to the provider immediately.

4.3 Abusive use constitutes any use that goes beyond the functional scope according to clause No. 2 of these terms of use.

5. Content Guidelines

5.1 The user is strictly prohibited from attempting to create content through FireChatbot that

• violates criminal law, youth protection regulations, or other applicable laws of the Federal Republic of Germany, the United States of America (USA), the United Kingdom, or the user's place of residence, is identical or similar to copyrighted, trademarked, or otherwise protected works of third parties,
• calls for child pornography,
• incites or calls for hatred,
• discriminates against people based on their religion, sexuality, gender, political views, worldview, or for other reasons,
• calls for harming others or oneself, or
• calls for or endorses animal cruelty.

5.2 Entering text into FireChatbot aimed at creating the aforementioned content is prohibited and will be reported to the investigating authorities if necessary.

6. Liability

6.1 The provider is liable without limitation for intent and gross negligence. For simple negligence, the provider is only liable for damages resulting from injury to life, body, health, or a material contractual obligation (an obligation whose fulfillment enables the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely).

6.2 In the event of a simple negligent breach of material contractual obligations, the liability of the provider is limited to the foreseeable, typically occurring damage. Otherwise, liability is excluded.

6.3 The provider is not liable for the loss of user data. The user is solely responsible for the secure storage of their data.

6.4 The provider is not liable for damages resulting from the user's violation of these terms of use.

6.5 The provider is not liable for the use of texts generated by FireChatbot outside the portal. In particular, the provider is not liable for any damages caused to the user by the assumption of copyright or exclusive usage rights.

6.6 The provider is not liable for damages to the user resulting from following advice, instructions, or general statements of FireChatbot.

6.7 The above limitations of liability also apply in favor of the provider's legal representatives and vicarious agents.

7. Data Protection

7.1 The provider processes users' personal data in accordance with data protection regulations, particularly the European General Data Protection Regulation (GDPR).

7.2 The provider stores conversations conducted by the user with FireChatbot without the sent images, as well as the date, time, and subject of the messages.

7.3 The provider also creates chat analyses. These include data such as interaction time with the chatbot, country of origin, or product interest.

7.4 If personal data is entered by the user, it is automatically deleted within one hour.

8. Final Provisions

8.1 The contractual relationship is governed exclusively by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

8.2 Should individual provisions of these terms and conditions, including this provision, be wholly or partially invalid or become invalid, the validity of the remaining provisions remains unaffected. Instead of the invalid or missing provisions, the respective statutory regulations apply.
